July 30, 2001

A meeting of Victoria County Municipal Council was held on Monday, July 30, 2001 at the Court House in Baddeck.

Present were:

Absent was District #2 Shane Toms.

Warden Gerald Sampson called the meeting to order at 5:00 pm. The topic under discussion was on the Solid Waste Contract and Tender Documents.

It was moved by Deputy Warden Bruce Morrison, seconded by Councillor MacInnes, that the time set for adjournment be 6:00 pm. Motion carried.

Discussion arose on the solid waste issues from the July 23 Solid Waste meeting. Mr. Art Pickup, Municipal Solicitor was asked to give his opinion on tendering giving local preference.

It was moved by Councillor Barron, seconded by Deputy Warden Morrison, that “local preference” be taken out of the tender and contract. Motion carried.

Discussion arose on the three different contracts. There is one for North, one for South and the trucking from the Transfer Station. It is not feasible for a compactor truck to do the transferring from the Transfer Station. It was decided that one contractor for the three areas would be cheaper for the Municipality. If you go with compactor trucks you would have to have the contract for a 4 year period.

It was moved by Deputy Warden, Bruce Morrison, seconded by Councillor MacInnes, that the Solid Waste contract be for a 4 year period commencing on

September 1, 2001 and concluding on August 31, 2005, including a ten percent (10%) deposit of the contracted price, in a certified cheque or bank draft be included with the tender documents, local preference to be excluded from the tender notice, compactor trucks are necessary for the North and South Collection but not for the trucking from the Transfer Station, and provision for recyclables pickup. There will be one contract for the three collections instead of three separate contracts. Motion carried.

Due to the time frame and the ability to obtain the equipment required for the collection of the new contract the present contractor will be called by Heather MacLean to see if he would be consider a one month extension to the solid waste collection. Solicitor Art Pickup will draw up the necessary papers if the contractor is in agreement.

It was moved by Councillor Wayne Budge, seconded by Councillor John MacInnes, that that motion be amended to state a five percent (5%) deposit of the contract amount with the tender documents. Proof has to be provided by September 15, 2001, that you have possession of the equipment necessary or will have access to the equipment, to commence the contract on October 1, 2001 instead of September 1, 2001.The proof has to be given before the tender is awarded. Motion carried with Councillor Barron and Councillor MacLellan voting against the motion.

It was moved by Deputy Warden Morrison, seconded by Councillor MacInnes, that the Tender Policy be approved first before the tender notice goes out. Solicitor Art Pickup was given direction to make the necessary amendments as discussed during council to the tender policy and tender ad. Motion carried.

Valid certification is required by the person/company applying for a tender package. This is certification has to be recognized by the Department of Labour.

The tender package would include the Solid Waste Contract, Solid Waste Management By-Law, and the Tender Policy.

It was moved by Coucillor MacInnes, seconded by Councillor Budge, that the meeting be extended to include the first reading of the Solid Waste By-Law NO. 0597. Motion carried.

It was moved by Deputy Warden Morrison, seconded by Councillor Budge, that the announcement for the second and third reading of the Solid Waste By-Law be advertised in the paper by Wednesday of this week. Motion carried.

It was noted that two applications were received for the casual landfill attendant to be hired on a rotating basis as the help is required.

It was moved by Councillor MacLellan, seconded by Councillor MacInnes, that $800 be given to MacIntosh’s Pioneer Cemetery, and $200 to Friends of the Veterans from District #8 Budget. Motion carried.

It was moved by Deputy Warden Morrison, seconded by Councillor Barron, that $250 be given to the Baddeck Fire Ladies from District #3 Budget. Motion carried.

Deputy Warden Morrison asked the solicitor for legal opinion on the easement for the sewer diversion. The owners were concerned with devaluation of the property if authorization of the easement is given. He wanted to know if it was acceptable to make an offer of $2500.

It was moved by Deputy Warden Morrison, seconded by Councillor MacLellan, that a letter be written by Heather MacLean, with the Solicitor’s approval, with an offer of $2500 for the easement. Motion carried.

It was moved by Councillor Barron, seconded by Councillor MacInnes, that the meeting be adjourned at 6:45 pm. Motion carried.
